Requests: The Applicants seek to expand the 2030 Urban Development Boundary to include approximately ±793.93 acres, the (“Site”) and redesignate the Site from “Agriculture” to “Special District”; amend the CDMP interpretive text of the Land Use Element to create the “South Dade Logistics & Technology District”; amend Policy LU-8H in the CDMP Land Use Element; amend Policy CM-9A in the CDMP Coastal Management Element. The Applicants have voluntarily proffered a Declarations of Restrictions in the Restrictions Table in Appendix A of the CDMP Land Use Element along with an associated Development Agreement.
The Board of Concerned Citizens of South Dade having reviewed the CDMP, specifically Policy LU-8G and LU-8F, finds the Applicants, proposed plan fails to demonstrate the need to develop land outside the UDB. The Application proposes to redesignate agricultural land to dramatically increase the supply of vacant industrial land by over 700 acres. As per staff analysis "the current absorption rate in the South Tier, if approved, will extend the depletion of industrial land supply, which is not projected to be depleted until after 2040, by over 100 years.” Furthermore, that Applicants proposes to create a District within a coastal high hazard area which is contrary to Policy CM-9E and additionally has failed to enumerate how the project will be developed, nor what adequate measures will be used to mitigate against any adverse impacts in accordance with CDMP.
The Board having conducted a thorough review of the staff analysis, the application, associated development agreement and after having consulted an independent Planning Professional, finds the request to be inconsistent with the CDMP and Florida State Statute Section 163.3177(6)(a)(9), as the Applicants have failed to demonstrate that the requested amendment thereto will not discourage urban sprawl. The Board finds the Development Agreement as presented to be deficient as further described in the attached letter under Exhibit A. The Board further finds the Development Agreement provides for a carte blanche to the Applicants, providing for a mechanism to maximize density and intensity for the Site, allows for a use variance process to allow prohibited uses, does not provide for safe guards to allow for the appropriate transition of uses, height or setbacks from the abutting residential or dissimilar districts (density and intensity) nor does it provide for any public benefits.
As such, the Board of Concerned Citizens of South Dade respectfully request that the Board of County Commissioners move to deny and not transmit the Applicants request to amend the CDMP and to expand the UDB as it is inconsistent with the goals, objectives and policies of the CDMP and Section 163.3177(6)(a)(9) of the Florida State Statute as further described in the
staff analysis.
